The terms that apply when you buy an EZY GPS tracker and use our tracking service. Please read the lawful use section before you order.

About EZY GPS

These terms apply to everything you buy from ezygps.com.au. Please read them before you order, and keep a copy — the version published when you place your order is the version that applies to it.

By placing an order you agree to these terms. Nothing in them excludes, restricts or modifies any right you have under the Australian Consumer Law.

What you are buying

Every plan includes a GPS tracking device, an Australian SIM, mobile data for the plan period, and access to the EZY GPS mobile app and web platform.

Five-year prepaid — A$275 including GST per device, plus A$11 standard postage per order. Device and service covered for five years from activation. No ongoing plan payments during that period. One device delivered costs A$286 including GST.

Annual — A$77 including GST per device per year, plus A$11 standard postage once per order. Device and service for twelve months, renewing at A$77 including GST per device yearly while subscribed, until you cancel. One device costs A$88 initially, then A$77 per year.

All prices include GST and a tax invoice is issued for every order. Business pricing shown excluding GST as A$250 and A$70 is the same price expressed a different way, not a different plan.

Standard postage is A$11 including GST (A$10 + GST) once per physical order for all devices, regardless of device quantity. It is not charged on service-only renewals.

Payment, renewal and cancellation

Payment is taken at checkout by Stripe. We do not receive or store your full card details.

Annual plans are subscriptions. A$77 is charged automatically to the same payment method twelve months after purchase, and yearly after that, until you cancel. We will email you before each renewal.

You can cancel at any time from your billing account at billing.stripe.com/p/login/cN2297cVc7lC3jacMM, or by emailing sales@ezygps.com.au or calling 1300 399 477. The same billing account lets you update your card and download your invoices. Cancellation takes effect at the end of the period you have already paid for, and the device stops reporting from that point.

Five-year plans are a single payment. Nothing is charged automatically afterwards.

Delivery

We deliver within Australia only, through Australia Post, to the delivery address you give at checkout. Orders are normally dispatched the same business day where possible, and otherwise the next business day.

Once your order is with Australia Post, delivery timeframes are theirs and are not something we can guarantee. If a parcel goes missing, contact us and we will help you trace it.

60-day money-back guarantee

If the tracker is not right for you, tell us within 60 days of delivery and send it back for a full refund of the plan price.

How to claim. Email sales@ezygps.com.au or call 1300 399 477 within the 60 days. We will give you a return address and a return reference.

What we need back. The device and everything that came with it — cables, mounts and documentation — complete, undamaged and in full working order.

What you cover. Return postage is at your expense. We recommend a tracked service, because the device remains your responsibility until it reaches us.

What is refunded. The full plan price, to the card used for the original purchase. The postage paid on the original order is not refunded, and neither is your return postage.

When. Within five business days of the returned device reaching us and passing inspection.

Limits. One guarantee claim per customer. The guarantee does not cover a device that is physically damaged, water damaged, opened, modified, or missing components. If a returned device does not pass inspection we will contact you before deciding anything, and you may have it sent back to you at your cost.

This guarantee sits on top of your legal rights, not instead of them. If a device is faulty, your rights under the Australian Consumer Law apply regardless of the 60 days — and in that case you do not bear the cost of returning it.

Warranty against defects

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

In addition to those rights, EZY GPS warrants that your device will be free from defects in materials and workmanship for five years from the date of delivery, on both plans.

What we will do: repair or replace the device, at our option, at no charge to you.

What you must do: contact us on 1300 399 477 or at sales@ezygps.com.au with your order reference and a description of the fault.

Who bears the expense of claiming: we do. We cover postage both ways on a warranty claim.

This warranty does not cover physical or water damage, unauthorised repair or modification, or damage caused by incorrect installation.

Service, coverage and limitations

The service depends on mobile network coverage and GPS satellite reception. Neither is available everywhere in Australia and neither is under our control. Tracking can be interrupted in tunnels, underground car parks, remote areas, and anywhere without mobile coverage.

The service must not be relied on as a security system, an emergency service, or a substitute for insurance.

Hardwired devices must be installed by a qualified auto electrician. We are not responsible for damage caused by incorrect installation, or for any effect installation may have on your vehicle warranty.

OBD devices need a compatible OBD-II port. Please check compatibility using the guide on our website before you order.

Lawful use — your responsibility

This is the most important clause in these terms. Please read it before you buy.

Australian law restricts where and on whom a tracking device may be used, and the restrictions are different in every state and territory. It is your responsibility to know the law that applies where you are and to comply with it. We supply the device; how you use it is your decision and your legal risk.

As a general rule that holds almost everywhere: only track a vehicle you own, or one you have the informed consent of the owner or lawful controller to track.

The summary below is general information only. It is not legal advice, it is not a substitute for checking the current law, and it will go out of date.

  • New South Wales — Surveillance Devices Act 2007 (NSW). It is an offence to install, use or maintain a tracking device to work out the location of a person without their express or implied consent, or of an object without the consent of the person in lawful possession or control of it.
  • Victoria — Surveillance Devices Act 1999 (Vic). The same in substance, with significant penalties for companies.
  • Queensland — there is currently no dedicated surveillance devices legislation covering private tracking devices. General law still applies, including unlawful stalking and coercive control offences. Reform has been consulted on following Queensland Law Reform Commission Report No. 77, so this position is likely to change.
  • Western Australia — Surveillance Devices Act 1998 (WA). Consent is required. Note there is no exception for tracking your own stolen property once it has left your possession.
  • South Australia — Surveillance Devices Act 2016 (SA). It is an offence to install, use or maintain a tracking device to determine a person's location without their express or implied consent.
  • Tasmania — no dedicated tracking device prohibition. General law applies, including stalking and harassment offences.
  • Northern Territory — Surveillance Devices Act 2007 (NT). Consent is required, on the same framework as New South Wales.
  • Australian Capital Territory — Crimes Act 1900 (ACT) and Workplace Privacy Act 2011 (ACT). Consent is required for tracking both people and objects.

Never acceptable, anywhere. Do not use an EZY GPS device to track a current or former partner, a family member, or any other person without their knowledge and consent. Doing so is a criminal offence in most Australian jurisdictions and may amount to stalking or coercive control. We will cooperate fully with any lawful request from police about such use.

We may suspend or close an account where we reasonably believe a device is being used unlawfully.

Tracking employees and work vehicles

If the person driving is not you, extra obligations apply.

  • New South Wales. The Workplace Surveillance Act 2005 (NSW) requires at least 14 days written notice to employees before tracking surveillance starts, setting out the kind of surveillance, how it will be carried out, when it starts, and whether it is continuous or intermittent. It also requires a notice clearly visible on the vehicle showing that the vehicle is subject to tracking surveillance. Covert tracking generally needs a court authority.
  • Australian Capital Territory. The Workplace Privacy Act 2011 (ACT) requires prior written notice of the type, timing and frequency of surveillance.
  • Victoria, Western Australia, South Australia and the Northern Territory. Consent from the person in lawful control of the vehicle is required under the relevant surveillance devices legislation.
  • Queensland and Tasmania. There is no dedicated statute, but employment law, privacy obligations and the general law still apply — and Queensland reform is expected.

If your business has an annual turnover above A$3 million, the Privacy Act 1988 (Cth) also applies to the location data you collect about your employees.

A practical minimum, whichever state you are in: a written vehicle tracking policy given to every driver before tracking starts, and a visible notice in each tracked vehicle. Ask us and we will send you both.

Your account and security

You are responsible for keeping your login details secure and for activity under your account. Please change the password we issue you the first time you log in, and tell us immediately if you think someone else has accessed your account.

After your plan ends

Five-year plan. At the end of five years the device is still yours and nothing switches off without notice. If you want to keep tracking, the service continues at A$77 including GST per vehicle per year. There is no obligation to renew.

Annual plan. Your plan renews yearly until you cancel.

Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures you are entitled to a replacement or refund, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they are not of acceptable quality and the failure does not amount to a major failure.

Nothing in these terms excludes, restricts or modifies those rights.

Our liability

To the extent permitted by law, and subject to your rights under the Australian Consumer Law, our liability arising out of supplying a device or the service is limited to, at our option, replacing the device, supplying the service again, or refunding the price you paid.

We are not liable for indirect or consequential loss, including loss of a vehicle or its contents, loss of profit, or loss arising from the service being unavailable.

Changes to these terms

We may update these terms from time to time. The version published on this page when you place an order is the version that applies to that order. These terms are governed by the law of Queensland, Australia.
