1. Definitions

In these Terms:We may collect the following types of personal information:
a) Identity and Contact Information

“Customer” means the person or entity purchasing or using EZY GPS products or services.
“Device” means any GPS tracking hardware supplied by EZY GPS.
“Service” means the GPS tracking service, software platform, SIM service, and related support.
“Account” means the customer account used to access the EZY GPS platform.
“You” / “Your” means the customer.

2. Services Provided

EZY GPS provides:

GPS tracking devices
SIM connectivity (where applicable)
Access to the EZY GPS tracking platform and mobile application

Related support services

EZY GPS does not provide security services, law enforcement services, recovery services, or emergency response services.

3. Lawful Use and Tracking Disclaimer

EZY GPS provides tracking technology only. We do not monitor, supervise, or control how you use the services. You are solely responsible for how the devices and services are used.

ou must ensure that your use of EZY GPS products and services complies with all applicable laws, including privacy, workplace surveillance, and consent requirements.

If you install a device in a vehicle used by another person, you must inform that person, obtain any required consent, and comply with all legal requirements.

EZY GPS is not responsible for any misuse of its products or services.

4. No Guarantee of Theft Prevention or Recovery

EZY GPS does not guarantee theft prevention, asset recovery, vehicle security, or prevention of misuse or unauthorised access.

GPS tracking is a support tool only. You remain responsible for security measures, insurance, and appropriate response to incidents.

5. Location Accuracy Disclaimer

You acknowledge that GPS data may not always be precise or real-time. Accuracy can be affected by environment, signal strength, obstructions, weather, and network conditions.

Location data is indicative only and should not be relied upon as exact or guaranteed. EZY GPS makes no warranty as to the accuracy or completeness of GPS data.

6. Account Responsibility

You are responsible for maintaining the confidentiality of your login details and for all activity that occurs under your account.

EZY GPS is not responsible for unauthorised access caused by your failure to protect your credentials.

7. Devices, Installation and Customer Responsibility

All EZY GPS devices are installed and used at the customer’s own risk.

You acknowledge and agree that:

EZY GPS does not perform installations unless expressly agreed in writing
You are solely responsible for choosing a qualified installer
You are responsible for ensuring installation is safe, compliant, and suitable for your vehicle
Installation may involve modification to vehicle wiring, trim, panels, or electrical systems

EZY GPS is not responsible or liable for:

Any damage to vehicles, electronics, or components arising from installation
Any electrical faults, battery issues, warning lights, or system errors
Any impact on vehicle warranties or manufacturer coverage
Any faults, defects, or failures caused by installation
Any actions or omissions of third-party installers

If EZY GPS recommends or refers an installer, such referral is provided as a convenience only and does not constitute endorsement, supervision, or responsibility for their work.

You release and indemnify EZY GPS from all claims, losses, damages, liabilities, and expenses arising from or related to installation.

8. SIM Services and Connectivity

Where SIM services are provided, connectivity depends on network availability. Coverage may vary by location, terrain, and conditions. Continuous connectivity is not guaranteed.

EZY GPS is not responsible for outages, delays, or disruptions caused by network issues.

9. Service Infrastructure and Availability

EZY GPS delivers services using a combination of systems, networks, and infrastructure. While reasonable steps are taken to ensure reliability, EZY GPS does not guarantee uninterrupted, error-free, or continuous service.

Services may be unavailable due to maintenance, updates, network outages, technical faults, or events outside our reasonable control.

EZY GPS is not liable for any loss arising from service interruptions.

10. Kill Switch / Immobilisation Features

Where supported and installed, kill switch (engine immobilisation) features must only be used when the vehicle is safely stationary and must be used lawfully and responsibly.

You acknowledge that not all vehicles are suitable for immobilisation features and that professional installation is required. Misuse can cause damage, safety risks, or legal consequences.

EZY GPS is not responsible for any loss, damage, injury, or liability arising from the use or misuse of immobilisation features.

11. Fees and Payment

You agree to pay all fees as set out at the time of purchase. Fees may include device purchase costs, subscription fees, SIM fees, and installation costs (if applicable).

All prices are in Australian dollars unless stated otherwise.

12. Subscription Terms

Where services are provided on a subscription basis, subscriptions renew automatically unless cancelled. You are responsible for cancelling before renewal if you do not wish to continue.

No refunds are provided for partial periods unless required by law.

13. Refunds and Cancellations

EZY GPS complies with the Australian Consumer Law.

Except as required by law:

Device purchases are non-refundable once used or installed
Subscription fees are non-refundable
Change of mind refunds are not provided

Nothing in these Terms limits your statutory rights.

14. Acceptable Use Policy

You agree that you will not use EZY GPS products or services to:

Track any person, vehicle, or asset without lawful authority or consent
Engage in harassment, stalking, intimidation, or surveillance of individuals
Invade the privacy of any person
Monitor employees or contractors unlawfully
Engage in illegal, fraudulent, or deceptive conduct
Interfere with, damage, or disrupt the services
Reverse engineer, tamper with, or modify devices or software
Use the services for any unlawful purpose

EZY GPS reserves the right to suspend or terminate services where misuse is suspected.

15. Limitation of Liability

To the maximum extent permitted by law, EZY GPS is not liable for indirect, consequential, or incidental loss, loss of profits, revenue, business, opportunity, data loss, business interruption, or misuse of the services.

Where liability cannot be excluded, it is limited to the amount paid by you for the relevant service.

16. Indemnity

You agree to indemnify EZY GPS against any claims, losses, damages, liabilities, or expenses arising from:

Your misuse of the services
Your failure to obtain consent
Your breach of these Terms
Your breach of any law

17. Suspension and Termination

EZY GPS may suspend or terminate your access to services if you breach these Terms, misuse the services, fail to make payment when due, or if required by law.

You may terminate your subscription in accordance with the cancellation process.

18. Changes to Services and Terms

EZY GPS may update, modify, or discontinue services and may update these Terms from time to time. The latest version will be available on our website. Continued use constitutes acceptance.

19. Privacy

Your use of the services is subject to our Privacy Policy, available at www.ezygps.com.au.

20. Governing Law

These Terms are governed by the laws of Queensland, Australia. You submit to the exclusive jurisdiction of the courts of Queensland.
